LEC Hosts Roundtable on Third Party Litigation Financing and Litigation Transparency

On Wednesday, March 26, 2025 the Law & Economics Center hosted a Luncheon Roundtable on Third Party Litigation Financing & Litigation Transparency at the Conrad Hotel in Washington, D.C.

Judge Trevor N. McFadden of the United States District Court for the District of Columbia, who also serves on the Advisory Board of the LEC’s Judicial Education Program, moderated the panel and offered short opening remarks on the topic and its importance. The program, featured as panelists the executive directors of two of George Mason University Antonin Scalia Law School’s influential academic centers — Jamil N. Jaffer, Assistant Professor of Law and Founder & Executive Director of the National Security Institute at George Mason University Antonin Scalia Law School; and Donald J. Kochan, Professor of Law and Executive Director of the Law & Economics Center at George Mason University Antonin Scalia Law School. The panel was rounded out with two additional experts on the topic — Maya Steinitz, Professor of Law at Boston University School of Law and Seth Katsuya Endo, Vice Dean of Intellectual Life and Associate Professor of Law at Seattle University School of Law.

The panel of experts discussed transparency in our civil justice system, especially when it comes to third party litigation financing (TPLF)—an increasingly used and scrutinized mechanism for financing lawsuits. It also examined issues around TPLF that should inform ongoing congressional and state legislative debates over laws designed to regulate this emerging financial market.

The luncheon was attended by more than 55 people, including private sector and government attorneys, academics, agency officials, corporate executives, and members of the press, among others.
